FEDERAL NOTICE TO CONSUMERS

SaltyRizz.com is a delivery seller of Electronic Nicotine Delivery Systems (ENDS) and related products as defined under the Prevent All Cigarette Trafficking (PACT) Act, 15 U.S.C. §§ 375–378, as amended by the Preventing Online Sales of E-Cigarettes to Children Act (effective March 27, 2021), and the Jenkins Act, 26 U.S.C. § 2343.

The following disclosures are made in compliance with federal law and are provided to inform you — the consumer — of your rights, our obligations, and the legal framework governing your purchase.

1. STATUTORY DEFINITIONS

1.1 Electronic Nicotine Delivery System (ENDS)

Under 15 U.S.C. § 375(7)(A), an ENDS is defined as:

"Any electronic device that, through an aerosolized solution, delivers nicotine, flavor, or any other substance to the user inhaling from the device," including an e-cigarette, an e-hookah, an e-cigar, a vape pen, an advanced refillable personal vaporizer, an electronic pipe, "and any component, liquid, part, or accessory of a device, without regard to whether the component, liquid, part, or accessory is sold separately from the device."

All products sold on SaltyRizz.com that fall within this definition are subject to the PACT Act, regardless of whether they contain nicotine.

1.2 Delivery Sale

Under 15 U.S.C. § 375(5), a delivery sale is any sale of covered products to a consumer where the order is submitted by telephone, mail, Internet, or other online service, or where the seller is not in the physical presence of the buyer at the time the order is placed, and where the products are delivered by common carrier, private delivery service, or other method of remote delivery.

All sales made on SaltyRizz.com are delivery sales subject to PACT Act requirements.

1.3 Delivery Seller

Under 15 U.S.C. § 375(6), a delivery seller is a person who makes a delivery sale. SaltyRizz.com operates as a delivery seller and is bound by all applicable obligations under the PACT Act.

2. REQUIRED PACKAGE LABELING LANGUAGE

Pursuant to 15 U.S.C. § 376a(b)(1), every package shipped by SaltyRizz.com bears the following federally mandated label:

"CIGARETTES / NICOTINE / SMOKELESS TOBACCO: FEDERAL LAW REQUIRES THE PAYMENT OF ALL APPLICABLE EXCISE TAXES, AND COMPLIANCE WITH APPLICABLE LICENSING AND TAX-STAMPING OBLIGATIONS."

This label is affixed clearly and conspicuously on the outside of every outbound package. Each package also displays the full legal business name, physical address, and telephone number of SaltyRizz.com as the delivery seller.

Any package lacking this label is treated as nondeliverable matter by compliant carriers pursuant to 15 U.S.C. § 376a(b)(2).

3. PROHIBITION ON USPS SHIPMENT

Pursuant to 18 U.S.C. § 1716E(a)(1), it is unlawful to use the United States Postal Service to ship cigarettes, smokeless tobacco, roll-your-own tobacco, or ENDS to consumers.

SaltyRizz.com does not use the United States Postal Service for any consumer shipments, under any circumstances. All orders are shipped exclusively through private, PACT Act-compliant carriers.

4. AGE VERIFICATION REQUIREMENTS

4.1 At Time of Purchase

Pursuant to 15 U.S.C. § 376a(b)(4)(A)(iii), SaltyRizz.com verifies the age and identity of every customer at the time of purchase. Before any order is processed, the following information is collected and verified through commercially available databases consisting primarily of data from government sources:

• Full legal name
  

• Date of birth
  

• Residential address
  

No order will be processed if the customer cannot be verified as at least 21 years of age. The federal minimum purchase age for all tobacco and ENDS products is 21, established under the Family Smoking Prevention and Tobacco Control Act and enforced by the U.S. Food and Drug Administration.

4.2 At Time of Delivery

Pursuant to 15 U.S.C. § 376a(b)(4)(A)(ii), every delivery requires:

• In-person receipt by an adult aged 21 or older
  

• Presentation of a valid, government-issued photo identification confirming the recipient is at least 21 years of age
  

• The adult purchaser's signature upon delivery
  

No package will be left unattended, delivered without identification verification, or released to any individual under the age of 21.

5. PACKAGE WEIGHT LIMITATION

Pursuant to 15 U.S.C. § 376a(b)(3), no package shipped by SaltyRizz.com to a consumer will exceed 10 pounds in total weight.

6. TAX COLLECTION AND REMITTANCE

6.1 State and Local Law Applicability

Pursuant to 15 U.S.C. § 376a(a)(3), all state, local, tribal, and other laws applicable to ENDS and tobacco products apply to SaltyRizz.com as if each delivery sale occurred entirely within the jurisdiction where delivery takes place. This includes all laws relating to:

• Excise taxes on tobacco and ENDS products
  

• Sales and use taxes
  

• Licensing and tax-stamping requirements
  

• Restrictions on the sale, distribution, or delivery of tobacco products, including flavor restrictions and product bans

6.2 Tax Payment

Pursuant to 15 U.S.C. § 376a(d)(1), SaltyRizz.com collects and remits all applicable federal, state, and local excise taxes and sales taxes. All applicable taxes are calculated based on the customer's shipping address and are displayed at checkout prior to order confirmation. Where required by state law, applicable tax stamps are affixed prior to shipment.

7. REGISTRATION WITH FEDERAL AND STATE AUTHORITIES

7.1 ATF Registration

Pursuant to 15 U.S.C. § 376, SaltyRizz.com is registered with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) as a delivery seller of ENDS and tobacco products. This registration is filed and maintained before the first delivery sale in any applicable state and is updated not later than the 10th day of each calendar month to reflect any changes.

7.2 State Tobacco Tax Administrator Registration

Pursuant to 15 U.S.C. § 376(a), SaltyRizz.com is registered with the tobacco tax administrator of every state into which we ship products. These registrations include our full legal name, business address, telephone number, email address, date of registration, and any modification to that information.

8. MANDATORY REPORTING TO GOVERNMENT AGENCIES

8.1 Monthly Reporting Obligation

Pursuant to the Jenkins Act (26 U.S.C. § 2343) and the PACT Act, SaltyRizz.com submits monthly reports to:

• The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF)
  

• The tobacco tax administrator of each state into which products were shipped during the reporting period

8.2 Information Disclosed in Reports

Each monthly report includes the following information for every delivery sale:

• Full name of the customer
  

• Shipping address
  

• Brand and type of products purchased
  

• Quantity of products purchased
  

• Date of the transaction
  

• Name and address of the shipping carrier used

8.3 Consumer Notice

BY PLACING AN ORDER ON SALTYRIZZ.COM, YOU ACKNOWLEDGE AND CONSENT TO THE DISCLOSURE OF YOUR NAME, ADDRESS, AND PURCHASE DETAILS TO THE ATF AND APPLICABLE STATE TOBACCO TAX ADMINISTRATORS, AS REQUIRED BY FEDERAL LAW. THIS REPORTING IS MANDATORY AND CANNOT BE OPTED OUT OF, WAIVED, OR MODIFIED.

9. RECORD RETENTION

Pursuant to 15 U.S.C. § 376a(c)(2), SaltyRizz.com retains complete records of all delivery sales for a minimum period of four (4) years from the date of the transaction. These records include:

• Customer name and address
  

• Products sold (brand, type, quantity)
  

• Date of sale
  

• Age verification results
  

• Shipping carrier and delivery confirmation
  

• Tax amounts collected and remitted
  

Records are stored securely and are made available to authorized federal and state officials upon lawful request.

10. STATE AND LOCAL COMPLIANCE

10.1 Shipping Restrictions

Certain states and local jurisdictions prohibit or restrict the online sale and/or delivery of ENDS and tobacco products. SaltyRizz.com maintains an up-to-date restricted jurisdiction list and does not process or ship orders to any jurisdiction where such sales are prohibited by law.

If an order is placed from a restricted jurisdiction, the order will be cancelled and a full refund will be issued.

10.2 Flavor Restrictions

Pursuant to 15 U.S.C. § 376a(a)(3)(D), if a state or local jurisdiction has enacted a law prohibiting the sale or delivery of flavored tobacco or ENDS products, SaltyRizz.com will not ship such products into that jurisdiction.

10.3 Product Directory Compliance

Where a state maintains an approved product directory or registry, SaltyRizz.com restricts product availability to only those products authorized for sale in that state.

11. PENALTIES FOR NONCOMPLIANCE

11.1 Delivery Seller Penalties

Under 15 U.S.C. § 377, violations of the PACT Act by a delivery seller may result in:

• Criminal penalties: Felony charge punishable by up to three (3) years of imprisonment
  

• Civil penalties: Up to $5,000 for a first violation; up to $10,000 for each subsequent violation
  

11.2 Consumer Notice

The PACT Act does not impose penalties on individual consumers for the purchase, use, or possession of tobacco or ENDS products obtained through a delivery sale. However, providing false identification or age information to circumvent age verification requirements may constitute fraud and may be referred to law enforcement authorities.

12. NONCOMPLIANT SELLERS LIST

The ATF maintains a list of noncompliant delivery sellers pursuant to 15 U.S.C. § 376a(e). Common carriers are prohibited from making deliveries for any entity appearing on this list. SaltyRizz.com is committed to maintaining full compliance with the PACT Act and all applicable laws to ensure we never appear on the noncompliant sellers list.

13. CARRIER OBLIGATIONS

SaltyRizz.com partners only with private carriers that fulfill the following PACT Act obligations:

• Verify the age and identity of the recipient at the point of delivery
  

• Obtain an adult signature upon delivery
  

• Refuse delivery if the recipient cannot present valid identification confirming they are at least 21 years of age
  

• Treat any unlabeled package known or suspected to contain ENDS or tobacco products as nondeliverable matter
  

• Refuse to deliver products for any seller appearing on the ATF noncompliant sellers list
  

• Maintain records of any delivery interrupted due to noncompliance for five (5) years
